Photography Contract Template for Indian Photographers (2026)

A photographer without a contract is one client disappointment away from a dispute over edited photos, RAW files, or whether the cousin with a DSLR counts as a second shooter.

Here are the clauses every Indian photography contract needs.

1. Scope of shoot

• Type of photography (wedding, portrait, product, corporate, event)
• Date, start time, duration, location(s)
• Number of deliverables (e.g. 150 edited photos, 20-page album, 2-minute highlight video)
• What is NOT included (pre-wedding shoot, drone footage, prints, additional hours)

Weddings and events

Be specific about how many hours you will shoot, how many events/functions (mehndi, sangeet, wedding, reception), and whether a second shooter is included.

Commercial/product

Number of products/setups/looks, usage rights (see below), turnaround time.

2. Delivery and turnaround

• Edited digital photos delivered in X days (common: 4-6 weeks for weddings, 2 weeks for portraits, 5 days for products)
• Delivery via digital download / gallery link
• Online gallery active for X days (60-90 days typical)
• Client must download and back up photos before expiry

3. RAW files

Specify this clearly — it is the #1 thing clients ask for:

"RAW (unprocessed) files are NOT included in this package. Final edited high-resolution JPEG/PNG files as specified will be delivered. RAW files remain the property of the Photographer and will be retained for 12 months following delivery."

If you do offer RAW files, charge a premium (typically 50% extra).

4. Copyright and usage rights

Under Indian Copyright Act, the photographer owns the copyright by default unless there is a written assignment.

Personal clients (portraits, weddings, families):

• Client receives personal use license (print, share, social media, personal albums)
• You retain portfolio/promotional rights (ask for consent for sensitive work)
• Client cannot sell photos to third parties or use commercially without additional license

Commercial clients (brands, products, companies):

• License scope must be defined: territory (India/worldwide), duration (1 year/perpetuity), medium (digital/print/all media), exclusivity
• Commercial usage usually commands higher fees
• Full copyright buyout is priced at a significant premium (2-5x)

5. Model/property release

For commercial use, you need a signed model release from any recognizable person and a property release from recognizable private property. Include a clause that client is responsible for obtaining releases where needed, or that you will provide a standard release form for them to arrange.

6. Payment terms

• 25-50% non-refundable booking retainer to reserve the date
• Remaining balance due before delivery of final photos
• Travel costs (trains/flights/fuel/hotels) billed separately or all-inclusive (specify)
• Cancellation by client: retainer is forfeited; within 30 days of event, 100% of fee due
• Cancellation by photographer: refund of retainer + referral to alternate photographer

7. Reshoots and client satisfaction

"Photographer will deliver images consistent with their established portfolio style. Selection, editing, and treatment of images is at the sole discretion of the Photographer. Reshoots are not available for events that have concluded; reasonable editing revisions (up to X) are included within 14 days of delivery."

You cannot recreate a wedding. Be explicit about editing style and artistic discretion.

8. Your safety and creative control

• If you or your equipment are endangered at an event, you may pause/withdraw without refund
• You have creative freedom over composition, lighting, posing consistent with your portfolio
• You are not responsible for missed shots due to guest obstruction, venue restrictions, weather, low light beyond camera capability, or events outside your control

9. Force majeure

Natural disasters, pandemic restrictions, last-minute government impositions — neither party liable, reschedule within 6 months or refund retainer minus expenses.
